For this infill proposal, the Principal of LPA, Lloyd Phillips, was retained as an Ontario Municipal Board (OMB) Expert Witness on behalf of the Applicant. The Applicant owns the corner lot known municipally as 35 Avenue Road, and had requested Minor Variances from the City of Ottawa Committee of Adjustment (CofA) for the purpose of permitting the construction of a new home that would allow them to “age in place.”

 

A reserved OMB Decision was provided following a two-day OMB Hearing which consisted of legal, planning and architectural presentations from respective experts on behalf of the Applicant. The rendered Decision upheld the CofA’s Decision to Grant the Minor Variances requested by the Applicant, with the exception of a minor change in the setback of one of the requested variances.
