40 Java is located in Wellington Village, a vibrant, walkable residential neighborhood, with access to the Wellington Street commercial strip.
The purpose of the application was to demolish the existing dwelling located on the property and subdivide the property into two separate parcels of land in order to create separate ownership for a proposed semi-detached dwelling, with one unit on each of the newly created lots.
Our role on this project was to provide planning advice on the appropriate scale of development for the site, prepare a Planning Rationale, manage the application process and present the application at the Committee of Adjustment hearing.
At the hearing, the concerns of local residents generally related to the potential loss of sunlight, trees and green space as a result of the new development. As well, they were concerned with the massing of the proposed building, which they felt would not fit in with the established character of the neighborhood.
Subsequently, the Committee was in support of the proposal and the applications for consent were approved as they met the statutory criteria in that a semi-detached is permitted in the R3E zone, the proposed parcels fully complied with the requirements of the Zoning By-law in terms of width, depth and area, and that the lots will be fully serviceable.
